Background

Since this site went up, I have been asked by a number of people whether audience members attending the Sylvia Browne episodes of the Montel Williams show are required to sign a non-disclosure agreement.

It has been reported in the past that people attending tapings of other psychic shows (John Edward's Crossing Over, James van Praagh's Beyond) were required to sign such documents, a practice which was criticized by skeptics as an attempt to silence reports of bad readings.

I was unable to answer this question about the Montel tapings, having never attended one myself. Recently however, someone who attended one of these tapings sent me copies of all documents received in conjunction with the taping.

I am placing them on this site for all to examine.

The Ticket

After ordering your tickets, your ticket arrives in the mail. It contains standard disclaimers, and looks like it is used for non-Sylvia Browne tapings as well as those for "Sylvia Browne Wednesdays."

Those attending a taping of one of the episodes featuring Sylvia Browne must sign the "Psychic Show Participation Release". The text of the release can be read below with my comments (all emphasis mine):

PSYCHIC SHOW PARTICIPATION RELEASE

1. I have agreed to appear as a guest on an episode of "The Montel Williams Show". Pursuant to the accompanying Program Appearance Agreement and other such agreements and releases executed and to be interpreted in conjunction herewith

2. I desire to talk with world renowned spiritual counselor and psychic medium Sylvia Browne during the production of the series, before a live audience, while being videotaped for a broadcast before a national television audience.

3. I am aware that during the course of the production of the Series I may be asked to say or do things or to reveal certain personal information which may be amusing, strange or embarrassing to me or other persons.

4. I further recognize and understand that I may be surprised, embarrassed and/or otherwise emotionally upset or distressed by information revealed to me (including without limitation, regarding missing and or deceased family members and or loved one) before a live audience and its broadcast before a national television audience.

5. For good and valuable consideration (the receipt and sufficiency of which I hereby acknowledge), including the opportunity to appear as a guest on the Series: (a) I voluntarily assume the full risk of any physical or emotional injury to myself or others or loss to any personal property, or loss of income that may occur as a result of my appearance on the Series and/or as a result of information revealed to me in connection with my appearance on the Series and/or the television broadcast of the Series; and (b) I forever release and discharge Mountain Movers Productions, Inc. ("Producer") and its distributors, assigns and affiliates, licensees, agents, officers, directors, shareholders, employees and attorneys, as well as Sylvia Browne, and each of them of and from any and all claims, debts, liabilities, demands, obligations, costs, expenses, actions and causes of action, of every nature, character and description, known or unknown on account of any injury to person or property or loss of income whatsoever which I may suffer or cause to be suffered as a result of my appearance on the Series and/or as a result of information revealed to me in connection with my appearance on the Series and/or as a result of the television broadcast of the Series.

6. In signing this release, I have not relied on any representations or other statements which are not contained herein. I further agree that no oral agreements or amendments are blinding on Producer unless and until reduced to writing and signed by a duly authorized officer of Producer.

7. The agreements shall be construed, interpreted and enforced according to the statutes, rules of law and court decisions of the State of New York. I consent to the exclusive venue for the adjunction of any disputes pertaining to the interpretation or enforcement of this agreement in the New York, New York, U.S.A. I consent to the exercise of personal jurisdiction over me by a court by a court located in New York, New York, USA having subject matter jurisdiction over any such dispute.

Analysis

There does not seem to be any "non-disclosure agreement" in the documents, so this would not account for the lack of reports of bad readings from those who have attended tapings. I would imagine this lack can mostly be accounted for by the fact that most people who attend such tapings are fans of Browne.

Apparently, clauses 4 and 5 of the Release are to protect Sylvia Browne, Montel Williams and others from a lawsuit in cases such as when Browne told Shawn Hornbeck's parents that their missing son was dead when was alive, or when she told the grandmother of missing five-year-old Opal Jo Jennings that Opal was alive and in sexual slavery in Japan when Opal had already been murdered in Texas, or any of a number of other cruel and distressing things she has told people on the Montel show for the sake of ratings.

It also gave Williams and the producers of the show the right to ignore the pleas of a woman who asked them not to show Browne telling her that her firefighter fiancé had drowned in the World Trade Center, as she felt it was disrespectful to her late fiancé.

All apparently in the name of ratings and "entertainment".
